Yes, there are definitely alternatives to litigation. It is possible that you and your attorney can try very diligently to resolve the case prior to filing a lawsuit, which is actually normal. The best way to do that would be to collect all of the evidence, speak with you about your case, get any photographs, whether it would be of your injuries, of the scene, talk to the witnesses, get your medical bills, your medical records, everything that will be important to the case and provide it to the other side, their insurance company, and negotiate with the adjuster of the insurance company and try to settle the case.
Beyond that, it’s possible to have a mediation where there’s a negotiator called a mediator who would be at the mediation with both sides and attempt to try and reach a resolution by negotiating, discussing the case between all of them, and in either one of these situations with the adjuster or the mediator will be possible to come to a settlement prior to filing a lawsuit. If that was done, then the paperwork will be signed. You’ll be compensated by being paid for your injuries. The case will be closed and there would be no court, no lawsuit.
