The statute of limitations would determine that and it depends on the type of case. For example, if it’s a medical malpractice case where the injury was caused by a medical practitioner, the statute of limitations is only two years. If it’s some other type of brain injury case, such as a car accident or a fall, where there was a brain injury that’s not related to a medical practitioner, then it would be a four year statute of limitations. And you would want to make sure that you don’t miss the deadline because if you do, if you file the suit after the deadline has passed, the judge will dismiss the case for missing the deadline.
