Yes, there are definite alternatives to going to court in accident case. Once your case has begun, prior to filing a lawsuit, your attorney or yourself can investigate the case, speak with any witnesses, and also contact the adjuster of the at fault party, the other side’s insurance company. Speak to them about the case. You’d have to establish that there’s liability, that the other party was the cause of the accident. You’d also have to establish your own damages, the value of your case through, for example, what treatment was required in the case for what period of time, your pain and suffering, and other possible damages. If you’re able to do that, you can settle with the adjuster. Another possibility is having a mediation with a negotiator, called a mediator, who would sit with you and the other party and help you to attempt to settle the case. If that can be done, then your case can be settled prior to having a lawsuit. Of course, you’d want to speak with an attorney before going to all these steps, especially having a mediation.
